2. General principles

These Terms and Conditions of Sale set out the terms of sale applicable to any contract for the sale of Products concluded off-premises between the company DIETANAT® and any consumer customer.

These Terms and Conditions of Sale apply to the exclusion of any other terms and conditions.

The Customer declares that they have read the following provisions before ordering Products.

Consequently, placing an order implies the Customer’s full and unreserved acceptance of these Terms and Conditions of Sale.

Failure to exercise, at any time, a right granted by these Terms and Conditions of Sale, or failure to require the application of any provision of the agreement resulting from these Terms, shall in no case be interpreted as an amendment to the contract, nor as an express or tacit waiver of the right to exercise that right in the future or of the right to require strict performance of the commitments made herein.

Should any of the terms of these Terms and Conditions of Sale be held illegal or unenforceable by a court decision, the other provisions shall remain in force.

2.1 Scope of the Terms and Conditions of Sale

These Terms and Conditions of Sale apply to all orders placed on the website www.dietanat.com, whatever the delivery country chosen among those offered when ordering. The countries served, the available carriers and the delivery costs are shown to the customer before the order is confirmed.

2.2 Changes to the Terms and Conditions of Sale

DIETANAT reserves the right to adapt or change these Terms and Conditions of Sale at any time. The applicable Terms and Conditions of Sale are those in force on the date of the Customer’s order.

3. Legal age and capacity

The Customer declares that they are legally capable of entering into this Contract, the Terms and Conditions of Sale of which are set out below, i.e. that they are of legal age and not under guardianship or curatorship.

4. Order process and description of the purchasing process

In order to comply with the French law on confidence in the digital economy of 21 June 2004, the ordering process is described below:

To place an order, internet users can select one or more items and add them to their cart. When their order is complete, they can access their cart by clicking on the dedicated button.

When viewing their cart, members can check the number and type of items they have chosen, as well as their unit price and the total price of the order. They can remove one or more items from their cart.

This summary will also inform customers whether or not they can exercise their right of withdrawal and the applicable time limits.

If they are happy with their order and wish to confirm it, internet users can click on the confirm button. They will then access a form in which they can either enter their login details if they already have an account, or register on the website by completing the form presented to them with their personal information.

Once they are logged in, or once they have fully completed the form, customers will be asked to check or change their delivery and billing details and will then be asked to make their payment by being redirected to the secure payment interface.

Once payment has actually been received by the website publisher, the publisher undertakes to acknowledge receipt to the customer electronically within a maximum of 24 hours.

Likewise, and within the same time limit, the publisher undertakes to send the customer an e-mail summarising the order and confirming that it is being processed, including all the information relating to the order, the products ordered, their delivery and how to exercise the right of withdrawal.

Prices shown on the website are in euros, including all taxes, excluding delivery costs. These prices may be changed at any time by the publisher; the prices displayed are only valid on the day of the order and do not apply to future orders.

4.1 Volume discounts, professional prices and referral programme

Some products benefit from volume discounts depending on the quantity ordered. They are shown on the product page and applied automatically in the cart. Products in the spirulina range are excluded.

Professional prices are reserved for professionals whose customer account has been approved by DIETANAT® after checking their SIRET number (or an equivalent business registration number outside France): practitioners and therapists (discount of up to 20%) and resellers (discount of up to 35% on DIETANAT® brand products, products of other brands remaining at the public price). Requests are made via the professional account request form. Once the customer is logged in, these prices are displayed excluding VAT. They replace volume discounts and cannot be combined with them. DIETANAT® reserves the right to refuse a request or to withdraw a professional account that no longer meets these conditions.

The benefits of the referral programme (welcome voucher for the referee, rewards for the referrer) are subject to the conditions displayed in the customer account. Unless otherwise stated, discount vouchers cannot be combined with each other.

4.2 Shipping costs

Delivery costs are in all cases shown to the customer before any payment. They depend on the delivery country, the carrier chosen and the weight of the order. Delivery is free for orders of €65 or more in mainland France (including Corsica and Monaco), Belgium and Switzerland.

The DIETANAT® products and items sold remain the property of the seller until full payment of their price, in accordance with this retention of title clause.

Product availability is shown on the website, in the description of each item.

4.3 Right of withdrawal

In accordance with Articles L. 221-18 et seq. of the French Consumer Code, the consumer Customer has fourteen (14) days to exercise their right of withdrawal with DIETANAT, without having to give reasons or pay any penalty. This period runs from receipt of the Products by the Customer or by a third party designated by them; for an order delivered in several parts, from receipt of the last Product. If it expires on a Saturday, Sunday or public holiday, it is extended to the next working day.

How to withdraw. Before the period expires, the Customer informs DIETANAT of their decision by means of an unambiguous statement, either:

  • online, from their customer account: My account > “Order history and details” > details of the order concerned, by ticking the products to be returned and then confirming the return request;
  • by e-mail to [email protected], stating the order number;
  • by post to: DIETANAT, Service retours clients, 8 route Mestre Marty, 47310 Estillac, France;
  • using the model withdrawal form reproduced below, the use of which is not compulsory.

DIETANAT acknowledges receipt of the withdrawal without delay, by e-mail.

Returning the Products. The Customer returns the Products no later than fourteen (14) days after communicating their decision, to the following address: DIETANAT, Service retours clients, 8 route Mestre Marty, 47310 Estillac, France. The direct costs of returning the Products are borne by the Customer. The Customer is only liable for any diminished value of the Products resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

Refund. DIETANAT refunds all sums paid, including the initial delivery costs (on the basis of the least expensive standard delivery method offered), no later than fourteen (14) days from the date on which it was informed of the withdrawal. It may withhold the refund until it has received the Products back or until the Customer has supplied evidence of having sent them back, whichever is the earliest. The refund is made using the same means of payment as used for the order, unless the Customer has expressly agreed otherwise, and at no cost to the Customer.

Exceptions. In accordance with Article L. 221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for Products unsealed by the Customer after delivery which cannot be returned for reasons of hygiene or health protection (food supplements, essential oils, plant extracts, cosmetics whose original packaging has been opened), nor for Products liable to deteriorate or expire rapidly.

5. Payment information

Internet users can place orders on this website and pay by bank card, cheque, bank transfer or money order.

Bank card payments are made by means of secure transactions provided by Crédit Agricole. For bank card payments, the publisher of this website has no access to any data relating to the user’s means of payment. Payment is made directly to the bank.

In the case of payment by money order, cheque or bank transfer, the delivery times defined in the article below only start to run from the date on which the seller actually receives the payment, which the seller may prove by any means

6. Delivery or collection

6.1 Delivery time

Orders are delivered by La Poste’s Colissimo service, within an average of 2 to 3 working days from full receipt by the seller of the corresponding price. The average delivery time is recorded with the carrier. In addition, DIETANAT undertakes to fulfil orders only within the limits of available stock.

If the Product ordered is unavailable, DIETANAT will inform the Customer as soon as possible and offer either a new date for receipt of the Product, a replacement Product, or cancellation of the order.

In the event of cancellation due to unavailability, the Customer will be refunded within fourteen (14) days of receipt of their cancellation request.

6.2 Delivery terms

Orders are delivered to the delivery address given when the order was placed. Subject to availability, and to the receipt and validation of your payment by our services, your order will be delivered no later than the date mentioned above. For orders placed at the weekend or on a public holiday, delivery times are counted from the next working day.

7. Force majeure

DIETANAT shall not be liable for any failure to fulfil its contractual obligations in the event of force majeure or a fortuitous event, including but not limited to disasters, fires, internal or external strikes, internal or external failures or breakdowns, and in general any event preventing orders from being properly fulfilled.

8. Provisions relating to consumer rights

The customer service of this website is available Monday to Friday from 10:00 to 12:30 and from 14:30 to 17:30 on the following non-premium-rate phone number: +33 6 69 57 22 27, by e-mail at the following address [email protected] or by post at the following address: SARL DIETANAT®, 8 route Mestre Marty, 47310 Estillac, France. In the last two cases, the publisher undertakes to reply within three working days.

In accordance with the legislation in force, consumers have 14 days, in accordance with Article L.221-18, from the date of receipt of the parcel to request an exchange or refund. To exercise this right, they must return the parcel to the address of our storage and shipping platform: SARL DIETANAT 8 route Mestre Marty, 47310 Estillac, France, together with a letter requesting either a refund or an exchange.

In accordance with Article L.221-28 of the French Consumer Code, consumers may not exercise this right for any products “which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly”.

Any delay in delivery may lead to the cancellation of the sale at the consumer’s initiative, upon simple written request. The consumer will then be refunded the sums paid when ordering. This clause does not apply if the delay in delivery is due to force majeure (see article 7), beyond the publisher’s control.
In such a case, the customer undertakes not to take legal action against the website and its publisher and waives the right to invoke the cancellation of the sale provided for in this article.

9. Receipt of products

The Customer must check the condition of the packaging and the conformity of the Product upon delivery and must immediately notify the delivery person of any reservations regarding the condition of the Product delivered so that they are recorded on the transport document: damaged packaging, damage suffered, conformity with the order, etc.

Any complaint regarding apparent defects or non-conformity of the Product delivered, as well as any damage related to transport, must be confirmed by the Customer to DIETANAT following receipt of the Product, either by registered letter with acknowledgement of receipt to the following address:

- 4 impasse du bourg, 47310 Roquefort, France

Or by e-mail to the following address:

-        [email protected]

The Customer must provide all evidence of the non-conformities, damage or defects observed.

Failing a complaint made within the above time limit and conditions, the Products delivered will be deemed accepted by the Customer.

By reporting the defect or non-conformity of the Product, the Customer will obtain a return authorisation from DIETANAT specifying the return address and procedure for the Products.

Once the return authorisation has been obtained, the Customer sends the Products back to DIETANAT at the address specified on the return authorisation, following the procedure indicated.

Any Product returned without DIETANAT’s agreement will be refused and returned to the sender at the sender’s expense and risk.

To be validly returned to DIETANAT and/or exchanged, the Products must not have been used and must be returned intact in their original packaging with any accessories, user manuals and other documentation.

If the Customer returns the Product for a proven lack of conformity confirmed by DIETANAT, the Customer must use the same delivery method for returning the Products as the one chosen for shipping the Products ordered. In this case, the return costs will be borne by DIETANAT by means of a return voucher or, failing that, by reimbursing the Customer for the actual amount of these costs (proof of shipping costs must be enclosed with the parcel; if it is missing, the Customer may not claim any reimbursement).

10. Warranty on products purchased on this website

The essential characteristics of the Products are described for each Product in DIETANAT’s catalogue and/or website. They were presented to the Customer before the order, as part of the pre-contractual information provided to them.

The Customer benefits from the legal guarantee of conformity (Articles L. 217-4 to L. 217-12 of the French Consumer Code) and the legal guarantee against defects in the goods sold (Articles 1641 to 1648 and 2232 of the French Civil Code).

10.1 Legal guarantees of conformity

Article L. 217-4 of the French Consumer Code:

The seller delivers goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery.

The seller is also liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was the seller’s responsibility under the contract or was carried out under the seller’s responsibility.

Article L. 217-5 of the French Consumer Code:

The goods comply with the contract:

  • 1. If they are fit for the use usually expected of similar goods and, where applicable:
    • - if they correspond to the description given by the seller and have the qualities that the seller presented to the buyer in the form of a sample or model;
    • - if they have the qualities that a buyer may legitimately expect in view of the public statements made by the seller, the producer or its representative, in particular in advertising or labelling;
    • 2. Or if they have the characteristics agreed by the parties or are fit for any special purpose sought by the buyer, brought to the attention of the seller and accepted by the seller.

Article L. 217-12 of the French Consumer Code:

Action for lack of conformity is time-barred two years after delivery of the goods.

Article L. 217-16 of the French Consumer Code:

When the buyer asks the seller, during the commercial guarantee granted at the time of purchase or repair of movable goods, for a repair covered by the guarantee, any period of immobilisation of at least seven days is added to the remaining duration of the guarantee.

This period runs from the buyer’s request for intervention or from the date the goods concerned are made available for repair, if this is later than the request for intervention.

10.2 Legal guarantees against hidden defects

Article 1641 of the French Civil Code:

The seller is bound by the guarantee for hidden defects in the goods sold which make them unfit for their intended use, or which so impair this use that the buyer would not have bought them, or would have paid a lower price, had they known of them.

Article 1648, first paragraph, of the French Civil Code:

Action resulting from redhibitory defects must be brought by the buyer within two years of discovering the defect.

In the event of a defect in a new product purchased on this website, customers have, in accordance with the provisions of the Civil Code on the legal guarantee against hidden defects, a period of 2 years in accordance with Article L. 121-2 g from the date of receipt of the product to request an exchange or refund. They will have two years from receipt of the product to request an exchange or refund if the goods delivered do not comply, within the meaning given to this word by the aforementioned article. To exercise either of these rights, they must return the parcel to the address of our storage and shipping platform: SARL DIETANAT 8 route Mestre Marty, 47310 Estillac, France, together with an explanatory letter requesting either a refund or an exchange. The cost of sending the parcel, in the latter case only, will then be refunded to the customer by cheque or bank transfer within a maximum of thirty days.

In addition to the guarantee against hidden defects defined by the Civil Code and the guarantee of conformity imposed by Article L. 217-12 of the French Consumer Code, which always apply where relevant and are defined above, items purchased on this website benefit from a contractual guarantee offered by the seller, of a duration varying from 12 to 36 months depending on the manufacturer’s specifications, which will be detailed on the page of each item.

10.3 Commercial guarantee

A commercial guarantee means any contractual commitment by a professional to a consumer to refund the purchase price, replace or repair the goods, in addition to its legal obligations to guarantee the conformity of the goods. The commercial guarantee is the subject of a written commitment, a copy of which is given to the buyer. This contract specifies the content of the guarantee, how it is implemented, its price, its duration, its territorial scope and the name and address of the guarantor, and reproduces Article L. 211-16 of the French Consumer Code. When a commercial guarantee is offered by the professional, the Terms and Conditions of Sale may refer to the guarantee contract and possibly present the information it contains

10.4 Spare parts

The period during which, or the date until which, the spare parts essential for using the goods are available was communicated to the Customer as part of the pre-contractual information provided before the Contract was concluded. It is also shown on the order form and remains available on DIETANAT’s website.

11. Liability

11.1 Compliance of Products with applicable standards

DIETANAT undertakes to sell Products that comply with the regulations and standards in force in France at the time of sale.

11.2 Non-compliant use/installation of the Product

DIETANAT declines all liability and cannot be held responsible for any damage caused to the Customer or a third party due to use of the Product that does not comply with its intended purpose.

12. Personal account

Creating a personal account is a prerequisite for any order placed by an internet user on this website. To this end, the member will be asked to provide certain personal information. The member undertakes to provide accurate information, failing which the contract may be terminated at the publisher’s initiative and the customer account deleted.

Certain information will be deemed essential to the conclusion of the contract, and its collection will be essential to the creation of the personal account and the validation of the contract. A member’s refusal to provide this information will prevent the creation of the personal account and, consequently, the validation of the order.

This account allows the customer or member to view all the orders placed on the website and, where applicable, to track the delivery of the goods purchased.

If the data contained in the personal account were to disappear as a result of a fortuitous event, a technical failure or force majeure, the publisher of this website could not be held liable, as this information has no evidential value and is provided for information only. The publisher nevertheless undertakes to securely retain all contractual elements whose retention is required by the law or regulations in force.

The pages relating to personal accounts can be freely printed by the account holder but in no way constitute proof; they are provided for information only, to help the customer manage their orders efficiently.

When creating the personal account, the user is asked to choose a password. This password guarantees the confidentiality of the information contained in their “my account” section, and the user therefore undertakes not to pass it on or disclose it to a third party. Otherwise, the website cannot be held responsible for unauthorised access to a user’s account.

The publisher reserves the exclusive right to delete the account of any member who has breached these terms and conditions (in particular, but without this example being exhaustive, when the member has knowingly provided incorrect information when registering and creating their personal account), or any account that has been inactive for at least one year. Such deletion shall not constitute damage for the excluded member, who may not claim any compensation as a result.

This exclusion does not preclude the publisher from taking legal action against the member where the facts justify it.

13. Member contributions

Members are given the opportunity to contribute to the content of this website by publishing comments or testimonials on their use of the products offered by the publisher on this website, or on their contractual relationship with the publisher.
Contributions, in the form of articles or comments, must be written in French and will be subject to approval by the publisher or its team of moderators.
Contributors are informed that the website publisher, represented where applicable by the moderators, may choose to publish the article in question in the newsletters of this website and on the websites of all its partners, provided that the publisher cites the pseudonym of the author of the contribution. The author therefore waives their rights to the content of the contributions in favour of the website publisher, for any distribution or use, even commercial, on the internet, always respecting the author’s authorship.

14. Publisher’s newsletter

By ticking the box provided for this purpose or by expressly giving their consent, members agree that the publisher may send them, at a frequency and in a form it will determine, a newsletter that may contain information about its business.
When the user ticks the box provided for this purpose, they agree to receive commercial offers from the publisher of this website for products and services similar to those ordered.

Subscribed members can unsubscribe from the newsletter by clicking on the link provided for this purpose in each newsletter.

Internet users can also delete cookies already stored on their computer via the relevant menu of their browser (usually tools or options / privacy). Amended by Law no. 2020-901 of 24 July 2020 - art. 3 (V)
Amended by Law no. 2020-901 of 24 July 2020 - art. 9

Consumers who do not wish to be canvassed by telephone can register free of charge on a telephone canvassing opt-out list.
A professional may not, directly or through a third party acting on its behalf, canvass by telephone a consumer registered on this list, except for solicitations made in the context of the performance of a current contract and related to the subject of that contract, including when offering the consumer products or services related or complementary to the subject of the current contract or likely to improve its performance or quality.
Any commercial telephone canvassing of consumers by professionals for the purpose of selling equipment or carrying out work on housing with a view to saving energy or producing renewable energy is prohibited, except for solicitations made in the context of the performance of a current contract within the meaning of the second paragraph of this article.
Any professional shall, directly or through a third party acting on its behalf, refer to the body mentioned in Article L. 223-4 in order to ensure that its commercial canvassing files comply with the telephone canvassing opt-out list:

The professional mentioned in the fourth paragraph complies with a code of good practice setting out the ethical rules applicable to telephone canvassing. This code of good practice, made public, is drawn up by the professionals operating in the telephone canvassing sector. It is specified by decree as necessary.
Any professional who has benefited from commercial solicitations of consumers made by telephone in breach of the provisions of this article is presumed liable for the breach, unless it can prove that it is not responsible for it.
Any contract concluded with a consumer following telephone canvassing carried out in breach of the provisions of this article is void.
The terms under which registration on a telephone canvassing opt-out list is tacitly renewable are determined by decree.

20. Disputes

If you are a “consumer” within the meaning of the preliminary article of the French Consumer Code, you must first send us your complaint directly using the contact form on DIETANAT’s website, selecting the subject “Complaint”.

If this attempt fails, you may use a conventional mediation procedure or any other alternative dispute resolution method, in particular by using, free of charge, within one year of your complaint, the competent consumer mediator in accordance with the provisions of Title 5 of Book I of the French Consumer Code.

To do so, in accordance with Article L. 616-1 of the French Consumer Code, the consumer may use a mediator.

In accordance with Article R. 616-1 of the French Consumer Code, the contact details of the mediator for any dispute with SARL DIETANAT® are as follows:

“In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, we offer a consumer mediation scheme. The chosen mediation body is: CNPM - MÉDIATION DE LA CONSOMMATION. In the event of a dispute, you can submit your complaint on its website: cnpm-mediation-consommation.eu or by post to CNPM - MÉDIATION - CONSOMMATION - 27 avenue de la Libération - 42400 Saint-Chamond, France”

If this mediation fails, or if you do not wish to use it, you remain free to submit your dispute to the competent courts.

21. Applicable law and jurisdiction

These terms and conditions are governed by French law.

In the event of a dispute relating to these terms and conditions or to the sale, the parties will try as far as possible to settle their dispute amicably.

Failing an amicable agreement, the competent court is that of the defendant’s place of residence or of the actual delivery of the Product.

22. Miscellaneous

These terms and conditions may be changed at any time by the website publisher or its representative. The terms and conditions applicable to the user are those in force on the day of their order or connection to this website. The publisher of course undertakes to keep all its previous terms and conditions and to send them to any user who requests them.
Except for public policy provisions, any disputes that may arise in connection with the performance of these terms and conditions may, before any legal action, be submitted to the website publisher with a view to an amicable settlement. It is expressly stated that requests for amicable settlement do not suspend the time limits for bringing legal action.

If any of the clauses of these terms and conditions were declared void by a court decision, this would not affect the validity of all the other clauses, which would remain in force.
The publisher’s failure to invoke, temporarily or permanently, one or more clauses of these terms and conditions shall in no case constitute a waiver of the right to invoke the rest of the terms and conditions.
